There are many reasons an individual may need others to act on their behalf to make decisions about their personal wellbeing, finances, or property. Some people suffer from injury or illnesses such as dementia or Alzheimer’s disease which mean they lack mental capacity to manage their own affairs. If you need specialist solicitors to make decisions for someone you know or someone you are related to, we can help.
What is the Court of Protection?
The Court of a protection is a specialist court which can make decisions for those who do not have the mental capacity. They can appoint a person to act as a Deputy (formerly called a Receiver). The measure was introduced in the Mental Capacity Act 2005 and was enshrined into law in October 2007 to provide impartial legal support for vulnerable members of society.
Who is the Court of Protection for?
The Court of Protection exists for anybody who does not have capacity to make complicated decisions. Whether from disability, old age, illnesses or injuries. The individual may require additional needs which means they cannot make decisions for themselves. Our teams can act on their behalf in the Court of Protection to appoint a deputy.
What is a Deputy?
A deputy is responsible for overseeing a person’s finances and making sure their day-to-day needs are met. This includes responsibility for the investment of funds and other assets. A deputy is required to submit an annual account to the Court of Protection and to prepare income tax returns if required. We can assist with these getting your head around these responsibilities.
