Creating a Will ensures that, when you pass on, what happens to your money and assets is set out and acted on. Many people prefer not to consider this subject while they are in good health, but it is important to have a will at any age.

Mirror Wills

Mirror wills are two nearly identical documents which allow couples with similar wishes to determine what will happen to their assets when they die. It is important for couples to complete these wills so that, if one partner passes away, the amount of inheritance tax paid will be minimised. Each individual signs their own will and can change their own will without their partner’s consent. These will be ideal for those who are married or in a civil partnership and especially if you have children.

Trust Wills

If you are considering including a trust as part of your will you will need greater protection for your assets. Including a trust in your will means your estate will not go directly to your beneficiaries but instead will be held in a specified way. Writing a trust will that everyone understands will provide greater peace of mind for you and your loved ones. As trusts are more complex, it important to instruct specialist solicitors who can advise you on how best to set them up.

Why should I make a Will?

There are a few important reasons for everyone make a will. Whether you have a small or large estate and no matter your age, now is always the right time if you are considering it.

  1. Deciding who receives your estate. If you die without making a Will, the intestacy rules set out who will receive your estate. If you are married, you probably think that your whole estate will pass to your spouse, but this is not the case! The estate may be shared with other relatives.
  • Planning for inheritance tax. Making a carefully prepared Will and arrangements during your lifetime can save considerable sums for your beneficiaries.
  • Deciding who will look after children under 18. Guardians should be appointed to take care of minors or there is a risk they can be taken into care.

Take control of what happens to your estate when you pass and instruct one of our solicitors to complete this important document with you.

Making a Will FAQs

What is a Will?

A will is a legal document which dictates what should happen your estate (money, property, assets, possessions) after you pass away.

What is a Will for?

A will’s purpose is to appoint guardians who will look after your kids (if under 18), appoint executors (people you trust to carry out the terms of your will), name beneficiaries of a will (people and organisations who will benefit from your estate) to leave gifts, create trusts and to state wishes for your funeral.

How Old do you have to be to Make a Will?

Anyone 18 or older can make a will. Your will covers the assets you have when you die, not your assets at the time of writing the will. This means that whatever age you are, or however many assets you have, you can create a will.

What Happens if I Don’t Create a Will Before I die?

If you don’t not have a Will before you die the law will decide what happens to your estate and who will look after your children. It is important to make these decisions for yourself and draw up a will to ensure your wishes are followed.

What is Undue Influence?

Undue influence refers to somebody being influenced by another to make a will or to amend an existing will. This is often for nefarious reasons and our solicitors will ensure that you are not creating your will under undue influence.
