There are a number of circumstances where it may be necessary to alter the terms of a lease. Examples include extending the lease term, allowing alterations to be made to the building (such as adding a satellite dish) or simply amending errors to enable a house sale.

What is Lease Variation?

Lease variation is a process where the lease (a binding legal contract) between the freeholder and leaseholder is varied to change certain terms. In some cases, there are tripartite leases which involve a third party called the manager. Organising lease variation can be difficult as it involves coordination between multiple parties with varying needs.

What is the Purpose of Lease Variation?

Lease Variation is there for individuals who want to contest any part of a lease whether it is in breach of Section 35 of the Landlord and Tenant Act 1985 or is vague on particular details on issues with the property (i.e. security equipment).

What is a Lease?

A lease is a legal contract between parties which agrees particular terms whilst renting residential or commercial property or even machinery or vehicles and more.They require a lessee to pay the lessor for the use of their property for a certain period of time.

What happens if Every Party Does Not Agree to Varying a Lease?

In this case, one party remains skeptical of the changes to the lease it must be taken to tribunal. An application must be made to a First-tier Tribunal (FTT). If this is the case, we suggest getting advice from a solicitor as soon as possible.

Can a landlord or Manager vary a lease without Agreement from tenants or freeholders?

If there is a clause in the housing contract, yes, a landlord or manager can vary a lease without agreement from the tenant or freeholder. These clauses, however, have limited significance and are general terms which give the landlord discretion over a wide area. It is important to receive legal advice in these situations as it can tricky to work around for both parties.

Who do I Contact if I Need to Vary a Lease?

You must speak with the other party members who signed the lease. It is important that both parties agree. If they do not agree, it may need to go to tribunal, in which case, it is important to seek legal advice from expert solicitors.
