The Right to Buy scheme was introduced in 1980 and allows tenants to purchase their council property at a discount. The Right to Buy is dependent on whether it is your only home, how long you have lived at your property, if the property is self-contained, that you are a secure tenant, and that you have had a public sector landlord (such as a council, housing association, armed services landlord or NHS trust for three years).

What Discount do you Receive with the Right to Buy Scheme?

The discount received with the Right to Buy Scheme is based on the market value of the property. The maximum discount is more than £80,000 or £100,000 in London. The discount increases each April. Other factors which influence the discount you will receive includes:

  • The length of tenancy
  • The type of property
  • The property’s value

Preserved Right to Buy

If, while you were living in it, your house was sold to a private landlord, you may have the Right to Buy. This is otherwise known as ‘Preserved Right to Buy’. Getting in touch with experts in the know can confirm if this is true for your case or not.

Right to Acquire

If you are not eligible for ‘Preserved Right to Buy’, you could be eligible for the ‘Right to Acquire’ scheme. This scheme is available to anyone who has had a public sector landlord for three or more years. Also, your property must have been bought or built by the landlord after 31st March 1997. It must be funded by a social housing grant. Alternatively, it will need to have been transferred from a local council to a housing association after 31st March 1997.

What is a Council House?

A council house can be any property, house, flat or bungalow built as public housing by the government for people to live in for reduced costs. Since the 1980s the government have been selling off these properties which is what the Right Buy to Scheme was created.

What is a Secure Tenant?

A secure tenant is someone who has the right to live in their property for the rest of their life. You can only be evicted by court order in serious situations as you have security of tenure.

Can I buy my Right To Buy property with Family Members?

Yes, if those family memebers live there and it is their principal home you can purchase the property together. They must have lived their for the 12 months preceding a Right to Buy application.

Can Someone Purchase the Property for me?

Yes, you can borrow money form family members if they do not live in the property but only you will be included on the Right to Buy application. Only a secure tenant can purchase a property through Right to Buy.

Will I need a Deposit to Purchase the Property?

Yes and many buyers use their discount as a deposit on the property.

I’m in Rent Arrears, Can I Still Buy the Property?

You can still apply but your rent account must be cleared of arrears by the time the sale goes through or it will fail.

Can I still buy the Property if I have Joint Tenancy and only I want to Purchase the Property?

Yes with consent from the other tenant you can apply and purchase the property. This is important as the other tenant must sign the Right to Buy application and verify their signature with their ID.
