Moving Home Conveyancing Process

Once you have made the decision to move home there is plenty to get done and many pieces of vital administration to complete. It is important to choose trustworthy conveyancers as you will want to stick with the same ones throughout the process

  1. Selling your house. The first step is to put your own house on the market. You will need to get your property valued to inform future decisions. Your solicitor will need to know about where you keep the deeds to your property, who provides your mortgage, and additional information such as planning permissions, building regulations, and by-law approvals. We also need copies of any guarantees 
  2. Buying a home. An exciting moment whether you are upsizing or downsizing, finding a new space to make your own is a great feeling. At this point your estate agent will provide us a Memorandum of Sale (a sale instruction) and obtain a contract pack from the seller’s solicitor. 
  3. Searches on the property. Your solicitor will suggest searches to be carried out on the property ahead of your purchase.This includes checking that the land will not be affected by proposed industrial work or public rights of way across the land. It is important to have these checked as these issues can affect the process.
  4. Receiving a mortgage offer. Once a sale is proposed it is important to have your mortgage provider arrange a mortgage valuation as you will need to share a copy of this with your solicitor. During the mortgage valuation only the property condition for lending will be reviewed, it is important to get an independent surveyor in if you have other concerns about the property. 
  5. Exchange of documents. Once all the documentation is together and all enquiries have been answered, your solicitor will arrange for an exchange date. This will mark the completion of the process and any funds – including money from the sale of your previous property and mortgage funds – to be released to you. Once agreed, solicitors for the buyer and seller will meet at the property and exchange contracts. A final completion date will be agreed and both parties are required to leave their properties by this date.
